Consumers purchase hand sanitizer and sanitizing wipes to keep themselves and their families safe from germs. Claims that these products can kill “99.99% of germs” or “99.9% of germs” are false because the ingredients in the products and method of application mean that the products do not kill certain germs. One study of hand sanitizer from the University of Ottawa found that the top three brands of hand sanitizer reduced the number of germs on the hands of eighth grade students by only 46-60%.
We have filed class action litigation against certain companies that sell hand sanitizer and sanitizing wipes based on the representations that the products kill 99.99% of germs. In these cases, we argue that consumers are misled and deceived by this label statement, and that consumers would not have purchased the products or would have paid less for them if they had known the truth about the limitations of hand sanitizers and sanitizing wipes to kill certain germs.
